In this guide

At many nikahs you will hear two words that sound alike: wali and wakil (in Urdu often "vakeel"). They are not the same role. Mixing them up can cause real confusion on the day, especially when a father lives abroad or the groom cannot attend.

In one sentence: a wali is a guardian by his relationship to the bride; a wakil is a representative someone appoints to act on their behalf. Here is what that means in practice.

What is a wali?

The wali is the bride’s guardian, normally her father, then other close male relatives on her father’s side. His role comes from who he is, not from an appointment: he represents her interests and, in the majority of schools, gives her in marriage in the contract. Our guides cover what a wali is and the role of the wali in nikah and who can be a wali.

What is a wakil?

A wakil is an agent appointed under the Islamic rules of agency (wakalah). Almost anyone with a role in the contract can appoint one:

  • The wali can appoint a wakil to say the offer on his behalf, for example an imam or an uncle, when he cannot attend or prefers someone else to speak.
  • The groom can appoint a wakil to accept the marriage for him, for example when he is in another country.
  • The bride can appoint a wakil in the Hanafi practice common in South Asia, where her vakeel, with two witnesses, asks for her consent and then conveys it in the gathering.

A wakil acts only within what he was asked to do. He cannot change the mahr, the spouse or the conditions he was given, and the person who appointed him can withdraw the appointment before the contract is concluded.

Wali vs wakil at a glance

  • Source of authority: wali, family relationship; wakil, delegation.
  • Who: wali, the bride’s closest eligible male guardian; wakil, any trustworthy Muslim adult chosen for the task.
  • Can it be passed on? A wali can delegate the act of contracting to a wakil, but he remains the wali.
  • Ends when: the wali’s guardianship ends with the marriage contract; a wakil’s task ends when it is done or the appointment is withdrawn.

Long-distance nikahs and video calls

When the bride, groom or wali are in different countries, a wakil is often the simplest way to hold a nikah everyone can be confident in. Scholars differ on contracts made live over phone or video, so many imams prefer that the absent party appoints a wakil who attends in person, with the appointment witnessed and written down.

Remember the civil side too. In Pakistan the nikah nama records the bride’s vakeel and the witnesses to that appointment; in the Gulf, marriage contracts are registered through the courts; in the UK, US and Canada a civil registration is usually needed alongside the nikah. Check the rules where the marriage will be registered.

Common mistakes to avoid

  • Assuming the imam is automatically the wali. He may be a wakil for the wali, or the wali for a woman with no guardian, but that should be clear and agreed.
  • Appointing a wakil without telling the bride. Her consent remains essential whoever speaks in the ceremony.
  • Using one person for several roles without checking. Schools differ on whether one person may act for both sides, so ask the officiating imam.

Planning a nikah with Nikkup

Frequently asked questions

Can the wali and the wakil be the same person? A wali can act himself or appoint a wakil. Whether one person may represent both bride and groom differs between schools, so confirm with the imam conducting the nikah.

Does the wakil have to be a man? Scholars generally expect a man to act as wakil in the marriage contract itself; ask your imam about your school’s view.

Can a nikah be done over Zoom? Scholars differ. Many advise appointing a wakil who is physically present, which avoids the disagreement.
